The following General Terms and Conditions regulate the registration and participation of all contractual partners (hereinafter referred to as "Customers") in conferences of Impuls Mediengruppe GmbH. The service provider is Impuls Mediengruppe GmbH, a service provider who, independently or on behalf of customers, produces journalistic products (e.g. JAVAPRO magazine for professional Java developers) and designs and organizes events.

2.1 Information on the scope of services

On the website or on the websites of the respective conferences (e.g. ) you will find information about the respective conditions as well as the scope of services and prices of upcoming conferences. Impuls Mediengruppe GmbH makes this information subject to change and non-binding. They merely represent an invitation to the customer to submit an offer.
2.2 Registration

Registration for participation in a conference by purchasing a ticket on account from Impuls Mediengruppe GmbH is subject to acceptance of these General Terms and Conditions. The registration constitutes a binding offer by the customer to the conditions of the event as presented on the website of the respective conference. The conditions published on the website on the day of receipt of the registration by Impuls Mediengruppe GmbH are decisive. Reservations and conditions formulated by the customer in the registration are inadmissible and shall be deemed not to have been made. The customer has no right to claim admission to the conference.
2.3 Right to participation

The customer's admission to the event depends on the respective participant and seat contingent. Impuls Mediengruppe GmbH considers registrations in the order of their receipt by Impuls Mediengruppe GmbH. If there is still a participation contingent for the respective event, Impuls Mediengruppe GmbH will send a binding order confirmation and the invoice for the participation fee to the e-mail address provided by the customer at the time of registration. These documents together represent the acceptance of the customer's offer by Impuls Mediengruppe GmbH. Any claim of the customer to participation in the event is subject to the condition that the invoice has been paid in full and on time.
3.1 Participation fee

Impuls Mediengruppe GmbH charges a participation fee for the event. The price stated in the order confirmation is the final price and binding for the customer. All prices are exclusive of 16% value added tax. The value-added tax will be shown in the invoice. No additional delivery and/or shipping costs shall be incurred unless they are shown separately.
3.2 Due date of the participation fee

The customer is obligated to transfer the participation fee within 10 days after receipt of the invoice to the bank account of Impuls Mediengruppe GmbH named in the invoice. The receipt of payment on the bank account of Impuls Mediengruppe GmbH is decisive. If the customer does not pay within 10 days after receipt of the invoice, Impuls Mediengruppe GmbH can withdraw from the contract. If Impuls Mediengruppe GmbH withdraws from the contract, the customer loses his right to participate in the event.
3.3 Travel and transport costs

Costs for, among other things, travel to and from the event, transport costs during the event and accommodation costs are not included in the participation fee.

Impuls Mediengruppe GmbH expressly reserves the right to make changes to the event, in particular the replacement or employment of additional speakers (for example, in the event that a speaker is unavailable), program changes and changes to the time schedule or venue. Impuls Mediengruppe GmbH will inform the customer about changes to the event (online).

5.1 Provision of a substitute customer

The customer is entitled to nominate a substitute customer in his place (hereinafter referred to as substitute customer) up to ten days before the start of the event. He shall inform Impuls Mediengruppe GmbH of this. The transfer of the contract to the substitute customer is effective as long as Impuls Mediengruppe GmbH receives a written declaration of consent from the substitute customer within two weeks, but in any case before the start of the event, under express acceptance of these General Terms and Conditions. Upon effective transfer of the contract to the substitute customer, the latter becomes the customer with effect from the time of transfer.
5.2 Withdrawal in case of default of payment

Impuls Mediengruppe GmbH is entitled to withdraw from the contract without notice if the payment deadline is not met.
5.3 Cancellation

If the customer does not wish to participate in the event, he must inform Impuls Mediengruppe GmbH of his withdrawal from the contract in writing (by e-mail, letter or fax). In order for the respective cancellation to be effective, it must be confirmed by Impuls Mediengruppe GmbH. The contract is only considered to be effectively cancelled if this condition is met.
5.4 Costs for additional services

Impuls Mediengruppe GmbH does not have to reimburse costs for additional services of third parties booked and paid for by the customer, which cannot be used by the customer due to the withdrawal of a contractual party from the contract.

6.1 Value added tax

All prices, fees and other costs are, unless expressly stated otherwise, plus the statutory value added tax.
6.2 Costs of a reminder and bank charges

If the customer defaults on a payment, Impuls Mediengruppe GmbH is entitled - without prejudice to further claims - to charge the customer costs of EUR 5.00 for the reminder, unless the customer can prove that Impuls Mediengruppe GmbH has incurred lower damages due to the default. The customer must also reimburse Impuls Mediengruppe GmbH for the costs of a return debit note or other costs arising from payment transactions for which the customer is responsible.
6.3 Cancellation costs

In the event of cancellation up to 30 days before the start of the event, the participation fee will be refunded with a processing fee of 85 Euro plus 19% VAT. In case of cancellation at a later date, the participation fee will not be refunded.
6.4 Costs for additional services of third parties

Costs for additional services of third parties not included in the scope of services of Impuls Mediengruppe GmbH, which the customer additionally uses in the context of the event (e.g. parking fees, hotel bar, telephone etc.), will not be paid by Impuls Mediengruppe GmbH, but are to be reimbursed by the customer directly to the respective service provider.
7.1. cancellation of the event

In the event that an event is cancelled, Impuls Mediengruppe GmbH will refund the payment made. In particular, Impuls Mediengruppe GmbH can cancel the event up to 10 days before the event begins if the number of participants specified in the event description is not reached. Shipping costs and other additional costs will only be reimbursed if the cancellation of the event is due to intent or gross negligence on the part of Impuls Mediengruppe GmbH.
7.2 Postponement of the event

In the event of a postponement, the customer is entitled to withdraw from the contract. Impuls Mediengruppe GmbH undertakes to inform the customer immediately at its own discretion via one of the addresses given at the time of booking (by post, e-mail, telephone, etc.). The sending of such information is considered sufficient. Any futile travel expenses, hotel bookings, etc. will only be reimbursed by Impuls Mediengruppe GmbH if the failure to inform the customer about the postponement or cancellation of the event is due to gross negligence or intent.
7.3 Reimbursement

In case of cancellation of the event, the participation fee will be refunded in full within 14 days. The same applies if the customer withdraws due to the reasons mentioned above.
8.1 Purpose of use

Impuls Mediengruppe GmbH collects, processes, stores and uses the following personal data of the customer in compliance with the Federal Data Protection Act: Name, address, e-mail address, telephone number, fax number (hereinafter "personal data"). Impuls Mediengruppe GmbH uses the personal data exclusively for the purpose of organizing the event or to process contracts concluded with the customer or to draw the customer's attention to other offers from Impuls Mediengruppe GmbH. By concluding the contract, the customer gives his consent, which can be revoked at any time, that Impuls Mediengruppe GmbH may make parts of his personal data (namely name and company) on the list of participants of the event publicly accessible to everyone.
8.2 Transfer to third parties

Impuls Mediengruppe GmbH will only pass on personal data to third parties if and to the extent that this is necessary for the purpose of processing the contract or for billing purposes. The customer can revoke a given consent with effect for the future at any time.
8.3 Rights of the customer

With regard to his personal data, the customer has the rights guaranteed by the Federal Data Protection Act to information, correction, deletion or blocking; these rights are to be exercised by sending a message by post or electronic mail to Impuls Mediengruppe GmbH. Upon request, the contact person will inform the customer about the personal data stored by Impuls Mediengruppe GmbH and the content of his consent.
9.1 Rights to materials, documents

Impuls Mediengruppe GmbH holds all intellectual property rights to materials, documents, documentation, audio and visual materials etc. that are distributed in connection with the event.
9.2 Recordings of the event

The customer is not entitled to make, distribute, duplicate or publish recordings, e.g. by photo or video camera or cell phone, within the framework of the event without the express written consent of Impuls Mediengruppe GmbH. Upon conclusion of the contract, the customer authorizes Impuls Mediengruppe GmbH to photograph or film him within the framework of the event and to make tape recordings. He grants Impuls Mediengruppe GmbH the right to use, duplicate and publish these photos, video films and tape recordings for documentation, promotion and advertising purposes. In this context, the customer transfers to Impuls Mediengruppe GmbH the exclusive rights of use, unlimited in time and space, with regard to his copyrights, ancillary copyrights, image rights, name rights and other protective rights, including personal rights, rights to photographs, rights to the voice, to interviews as well as to biographical information.

9.3 Advertising at the venue

The customer is not entitled to display or issue advertising for companies at the event location. Violations will be punished by exclusion from the conference.
10.1. Disclaimer of liability

The liability of the Impuls Mediengruppe GmbH for contractual, contract-like, statutory, tortious or other legal reasons is excluded. This does not apply if it involves injury to life, limb or health or if the injury is based on willful or grossly negligent behavior on the part of Impuls Mediengruppe GmbH or its vicarious agents, or if it is a violation of the purpose of the contract essential obligations (cardinal obligations). Due to a slightly negligent breach of cardinal obligations, liability is limited to the foreseeable damage and the amount of the participant price; furthermore, liability for consequential and indirect damage is excluded.
10.2 Arrival and departure

Liability for damage, including incurred when traveling to and from the event locations is excluded.
11.1 Applicable Law

It is only the law of the Federal Republic of Germany. The UN sales law (CISG) does not apply.
11.2 Place of performance

The place of performance for all legal relationships between Impuls Mediengruppe GmbH and the customer is Tirschenreuth.
11.3 Place of Jurisdiction

Tirschenreuth is agreed as the place of jurisdiction for customers who are registered traders as well as those who do not have a general place of jurisdiction in Germany.
11.4 Written form requirement

Changes and additions to a contract as well as declarations and individual instructions must be made in writing. This also applies to the written form requirement.
11.5 Changes

Impuls Mediengruppe GmbH reserves the right to change these general terms and conditions at any time. The changed general terms and conditions become part of the contractual relationship with the notification to the customer, unless the customer objects to the change within one month.
11.6 Severability Clause

Should individual provisions of these terms and conditions be ineffective or become ineffective at a later point in time, the effectiveness of the others remains unaffected. The ineffective provision is to be replaced by that effective provision whose effects come closest to the economic objective of the ineffective provision.
